Title of Agenda Item: Consideration of Northside and Pine Knolls Community Plan and Proposed Amendments to the Northside and Pine Knolls Neighborhood Conservation Districts.  R-9,R-10,R-11,O-4,O-5,O-6

Background: Tonight the Town Council continues the public hearing from November 21, 2011 about the adoption of the Northside and Pine Knolls Community Plan. The Plan represents the Town and community response to the temporary moratorium in the Northside and Pine Knolls neighborhoods that was enacted by the Town Council on June 21, 2011. The moratorium has temporarily halted most development activity in these areas while the Community Plan is being developed. The temporary moratorium will expire on January 31, 2012.

Fiscal Note: Adopting the Northside and Pine Knolls Community Plan would not commit funding to the activities included in the Plan or to a specific agency or organization, but would indicate support of future budget considerations of the strategies included in the Plan.  We could include the cost of implementation in the Priority Budgeting process as described by the Manager on October 10, 2011, which involves the inclusion of community input on priorities and a focus of resources on the highest of those priorities.

Recommendations: We recommend that the Town Council enact the attached resolutions to:
  1. Adopt the Community Plan;   
  2. Establish a fee schedule; and
  3. Initiate a process to amend the Land Use Management Ordinance to authorize Planning Board to review Special Use Permits for Single-Family residential development in Northside and Pine Knolls.
We also recommend that the Council enact the attached ordinances to amend:
  1. The Northside Neighborhood Conservation District;
  2. The Pine Knolls Neighborhood Conservation District; and
  3. The Land Use Management Ordinance variance provisions for the “house size” standards of the Northside and Pine Knolls Neighborhood Conservation Districts.
We note one change to our preliminary staff recommendation: the proposed amendment to the Pine Knolls Neighborhood Conservation District Floor Area Ratio regulation was removed. We now recommend that the current Floor Area Ratio standard of .25 be maintained.
