Title of Agenda Item: Consider Application for Special Use Permit - Charterwood, 1641 Martin Luther King Jr. Boulevard.  (R-15) (R-16)

Council Goal: Focus on Economic Development, Land Use, and Transportation for a Balanced and Sustainable Future

Background: The public hearing for this application was closed on January 30, 2012. The accompanying Zoning Atlas Amendment application is before the Council tonight for a second reading. If the rezoning application is approved, the Council may consider acting on this Special Use Permit application.

The application, if approved, would allow construction of approximately 278,000 square feet of floor area. The application proposes 134-154 dwelling units, 27,000-40,000 square feet of office space, 18,000-27,000 square feet of specialty retail, and a 5,000 square foot drive-through bank as part of a Planned Development. The 15.7 acre site is located on the west side of Martin Luther King Jr. Boulevard just south of Weaver Dairy Road and is presently located in the Residential-2 (R-2) zoning district.

Fiscal Note: No fiscal impact determined at this time.

Recommendations: That the Council consider action on the application. If the property is rezoned, we recommend approval of Revised Resolution A.
